Fees, third-party fees, and taxes

Our current fees and prices for our Services can be found at https://biglofty.com/pricing. Our fees and prices are subject to change. If we change the fees and prices, we will notify you of the new fees and prices one month in advance by contacting you on the website mentioned above or via email. If you do not want to accept the new fees and prices, you may terminate the Services/this Agreement within this month by contacting us on your Account page or by email or in writing.

If you purchase any of our Paid Services, you agree to pay us the applicable fees, all applicable taxes, and all applicable third-party fees (e.g., telephone toll charges, mobile service provider fees, ISP fees, data plan fees, credit card fees, foreign exchange fees, foreign transaction fees). We are not responsible for these fees charged by third parties you employ. Contact your financial institution with fee-related questions. We may take steps to collect fees owed by you. You are responsible for all related collection costs and expenses.

Our fees and the scope of our services may vary based on your specific consumer behavior.

Credit Card Information

To avoid interruptions to your service if you do not notify us of updates to your payment method, we may participate in programs supported by your card provider to update your payment information, and you authorize us to continue billing your account with the updated information we receive.

Billing

Unless your subscription is cancelled or expired, we will automatically bill you for subscription fees based on the plan, price and payment method you selected. If you do not cancel your subscription, it will renew automatically.

You and BigLofty may cancel or terminate your subscription at any time. Any cancellation will take place from the next billing period, i.e. any cancellation will only cancel future billings. We do not provide refunds, except in cases requested by mandatory law or as expressly informed to you. All fees are exclusive of all taxes, duties or charges imposed by tax authorities, and you will be responsible for the payment of all such taxes, duties or charges.

Free Trial

The free trial will last for the period stated on the website. After this free trial, your chosen payment method will be charged the regular fee. If you sign up for a free trial, you will need to submit your payment information so that automatic payment can occur when the free trial period ends. If you do not wish to continue with our service after the free trial period ends, you must cancel the service within the free trial period. You can cancel the free trial on your Account page.

This free trial is for new customers only and may not be available for all services, regions, countries, or currencies. Smallpdf reserves the right to remove or cancel the free trial offer at any time without reason.

Your indemnification obligations

You will indemnify us and our subsidiaries, affiliates, officers, agents, employees, partners and licensors from any claim, demand, loss or damage, including reasonable attorneys’ fees, arising from or relating to your Content, your use of the Services or Software, or your violation of these Terms.

Disclaimer of warranty

WARRANTY OF SERVICES AND SOFTWARE

The Services and Software are provided “as is.” To the maximum extent permitted by law, we disclaim and exclude any and all express or implied warranties, including implied warranties of non-infringement, merchantability, or fitness for a particular purpose. We make no commitments about the content in the Services. We further disclaim and exclude any and all warranties that (a) the Services or Software will meet your requirements or will be continuously available, uninterrupted, timely, secure or error-free; (b) the results that may be obtained from the use of the Services or Software will be effective, accurate or reliable; (c) the quality of the Services or Software will meet your expectations; or (d) any errors or defects in the Services or Software will be corrected.

Liability for Services and Software, information and templates

We expressly disclaim any liability for any actions arising out of your use of any Services or Software. You may access and use the Services or Software at your own volition and risk, and you are solely responsible for any damage to your computer system or loss of data that results from access and use of any Services or Software.

The information and templates provided by BigLofty BL (we, us or our) on www.biglofty.com (the website) and our mobile applications are provided for informational purposes only. All information on the website is provided in good faith, however under no circumstances will we be liable to you as a result of your use of and/or reliance on the information, templates, services or software.

Electronic Signature

BigLofty does not guarantee that the electronic signature provided through its e-Sign tool is legally binding in your country or under the laws of the country governing the legal transaction that the signing process is intended to perform. Smallpdf disclaims any liability for contracts that are not closed, lost or signed prematurely due to the use of the e-Sign tool. We also do not guarantee that we have saved a copy of your contract.

Storage of files

Our storage feature is available cross-platform. We cannot promise that stored files will always be available to you or accessible by you. A copy of your document should always be saved on your own device. We are not responsible for lost documents and will not be liable for any loss.

Limitation of Liability

Liability of BigLofty

BigLofty is not liable to you or anyone else: (a) for any loss of use, data, goodwill or profits, whether foreseeable or not; and (b) special, incidental, indirect, consequential or punitive damages of any kind (even if we have been advised of the possibility of these damages), including those resulting from (x) loss of use, data or profits, whether foreseeable or not, (y) based on any theory of liability, including breach of contract or warranty, negligence or other tort action, or (z) arising from any other claim arising out of or related to your use or access to the Services or Software. Nothing in these Terms limits or excludes our liability for gross negligence, our (or our employees’) willful misconduct, or death or personal injury.

Limited liability

Smallpdf’s total liability for any matter arising out of or relating to these Terms is limited to CHF 100 or the total amount paid by you for access to the Service and Software during the three month period preceding the event giving rise to the liability, whichever is greater. This limitation will apply even if we have been informed of the possibility of the liability exceeding the amount stated above and notwithstanding any failure of the essential purpose of any limited remedy.

Termination

Termination by You

You may stop using the Services at any time. Termination of your account does not relieve you of your obligation to pay any outstanding fees.

If you do not want to accept the new fees and prices, you may terminate the Services/this Agreement as described above in Section.

COST OF THE BigLofty MEMBERSHIP

Access to BigLofty services will be charged at ₹xx,xx per month. Billing will be done on the anniversary date of Direct Debit or if this is not possible, on the last day of the month. Your subscription will be paid by Direct Debit and will be credited to BigLofty or www.biglofty.com.

We reserve the right to change pricing at any time by notifying current active users. These changes will not affect the user’s current subscription term. The price in effect ten (7) days prior to subscription renewal will apply to payment for the renewed subscription term.

CONDITIONS OF THE BigLofty MEMBERSHIP

The duration of a BigLofty subscription is one month and will automatically renew at the end of the current subscription period.

You can cancel your BigLofty subscription at any time without any conditions and free of charge.

Storage and transfer of information

The information will be stored on secure servers, monitored and maintained in accordance with privacy safeguards. We may store or transfer information relating to data subjects located in Indian territory to servers located in countries considered appropriate by the Indian Commission, or also to countries not considered appropriate by the Indian Commission, provided that those countries implement appropriate and adequate security measures with respect to the protection of personal information.

Information is stored on the servers only for as long as necessary to provide the services and maintain the integrity of our databases. We will keep records of processing activities for the purpose of demonstrating compliance with India’s GDPR.

Some services require third-party solutions. When you are redirected from our site to a third-party website, you are no longer able to interact with our site. Any information you provide through third-party websites will be used in accordance with their privacy policy and other applicable terms.
